Terms of Service

These terms govern your use of Comics That Pop (the “Service”), a browser-based tool for making comics. By using the Service you agree to them.

Who we are

Comics That Pop is an independently built tool. You can reach us at hello@comicsthatpop.com — that address is monitored and is the right place for any question about these terms, your privacy, or a problem with the Service.

Who can use it

Making comics is for everyone, at any age. The editor needs no account, runs entirely in your browser and sends us nothing, so there is nothing here for us to gate.

To create an account and use the AI features you should be 16 or over, because those features send content to a third-party AI provider and we hold an email address for you. If you are under 16, a parent or guardian can hold the account and use the AI features with you.

To buy anything you must be 18 or over, or have the permission of a parent or guardian who accepts these terms on your behalf. That is about being able to enter a contract, not about the comics.

What the Service does

Comics That Pop runs in your web browser. You build comic pages from your own photos, GIFs and sound, and export them as video, PDF, PNG or eBook files.

Your comics stay on your device. Pages, photos, audio and exports are stored in your browser’s local storage and are generated on your own device. We do not receive, store or have access to them. See the Privacy Policy for the detail.

The one exception is the AI features, which cannot work on your device alone. When you ask the AI to transform a panel or build a character reference sheet, the images and text needed for that request are sent to us and passed to an AI provider. This only happens when you press the button, and only for the panel or photos involved — see Privacy and the section below.

Your content is yours

You keep all rights to the comics you make and the material you put into them. We claim no license over your content. Everything except an AI request stays on your device, so for that material we could not use it even if we wanted to.

When you use an AI feature, you give us permission to send that panel or those photos to our AI provider for the single purpose of fulfilling your request — nothing more. We do not use your content to train models, and we do not keep it beyond what that request needs.

Backups are your responsibility

Because your work is held in your browser, it can be lost in ways we cannot prevent or recover from — clearing site data, browser privacy settings, uninstalling the browser, or losing the device. Use the backup feature to save a copy of anything you care about. We cannot restore lost comics.

Acceptable use

You agree not to use the Service to:

Create or process material you do not have the rights to, including copyrighted images, GIFs or audio belonging to someone else.
Create material that is unlawful, defamatory, harassing, or that sexualises or endangers children.
Load URLs that point at private, internal or restricted network addresses, or otherwise attempt to misuse the URL-loading feature.
Interfere with the Service, attempt to gain unauthorised access, or place unreasonable load on it.

Because content is created and stored on your device, you are solely responsible for what you make and for having the rights to the material you use — including anything you load by pasting a link.

AI features

Some features generate images using a third-party AI model. They are optional, available to signed-in accounts, and are never used unless you choose them.

What you may not do with them. The models we use come with their own content policies, and those apply to you as well as to us. You agree not to use the AI features to attempt to create, or to assist in creating:

Sexual or sexually suggestive content, nudity, or any content that sexualises a person.
Graphic violence, gore, or content glorifying self-harm, cruelty or terrorism.
Hateful, harassing or demeaning content directed at a person or a group, including on the basis of race, religion, sex, gender, sexuality, disability or nationality.
Depictions of a real, identifiable person — including public figures — without their consent, and never in a way intended to mislead about what they said or did.
Anything sexual or endangering involving a minor. This is absolute, has no exception, and will be reported where the law requires it.
Content that is unlawful, that infringes someone’s rights, or that is designed to deceive — forged documents, fake evidence, impersonation.
Any attempt to evade, disable or work around a provider’s safety filters, or to use the feature through automation rather than the app.

These are not our preferences alone. Our access to the models depends on these rules being kept, so breaking them puts the feature at risk for everyone using it.

Requests may be refused. The provider applies its own filters, which we do not control and cannot override. A refused request is a normal outcome rather than a fault, and where a generation fails we return the credits it would have cost. Repeated or deliberate attempts to generate prohibited content may cost you access to the AI features, or to the Service.

What we claim, and what we cannot promise. We claim no rights over the images you generate, and we will not use them for anything beyond answering your request. What we cannot do is tell you what rights you have in them:

Whether an AI-generated image can be owned at all is unsettled law, and differs by country. In much of Europe copyright requires human authorship, so a generated image may not be protected at all. We make no promise either way, and you should not assume you can stop anyone else using something similar.
Generated images are not unique. A similar prompt may produce a closely similar result for somebody else.
We cannot warrant that a generated image is free of third-party rights. Models are trained on large datasets and an output can resemble existing work. Deciding whether something is safe to publish, and bearing the consequences, is yours.
Use of the output is also subject to the AI provider’s terms, which may change without us being consulted.

You are responsible for having the rights to any photo you upload as a reference, including photographs of other people, and for obtaining any consent needed before uploading a picture of someone else.

These features may change. They depend on a third-party model we do not control. We may alter, limit or withdraw them, including if a provider changes its terms, prices or availability. Where that would affect credits you have paid for, see Cost below.

Our brand

The Comics That Pop name, logo and the software itself remain ours. Exports carry a small Comics That Pop watermark; please do not strip or obscure it.

Cost

Making comics is free, with every editing feature and every export format available to everyone. Exports carry a small Comics That Pop watermark.

The AI features are metered, because each generated image costs us money to produce. A signed-in account gets an allowance of credits; a standard generated image is one credit and a High-quality one is two, and the cost of an action is always shown before you commit to it. We may introduce paid plans for larger allowances and an option to remove the watermark. If we do, these terms will be updated before anything is sold, and nothing you can do today will start costing money without you being told first.

Credits. There is no subscription — credits are bought in packs, one payment at a time. Credits you buy do not expire. Where we grant an allowance, it is exactly that: it does not carry over, and it is always spent before credits you paid for, so purchased credit is never lost to a reset. Credits have no cash value and cannot be exchanged for money.

If you are an EU consumer, you normally have 14 days to withdraw from a distance contract. Because credits are usable immediately, we ask you to agree at checkout that supply begins at once and to acknowledge that you lose the right of withdrawal for any credits you have already used. Credits you have not used are refundable within those 14 days.

If we withdraw the AI features altogether, we will refund unused credits you paid for.

Availability and disclaimers

The Service is provided “as is”. We aim to keep it working and available, but we do not warrant that it will be uninterrupted, error-free, or that exports will succeed on every device or browser. Export performance and supported formats vary between browsers and devices, particularly on mobile.

Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, or for lost content, lost profit or lost opportunity — including work lost from your browser, and including anything arising from your use of a generated image.

Where we are liable, and to the extent the law allows us to limit it, our total liability is capped at the greater of the amount you paid us in the twelve months before the claim, or US$50.

Nothing in these terms removes or limits your statutory rights as a consumer, nor our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

Your responsibility for what you make

You decide what to create and what to publish. If a claim is brought against us because of content you created, published or uploaded — because it infringed someone’s rights, broke the rules above, or broke the law — you agree to cover the reasonable costs and damages we incur as a result.

This applies to how you use the Service, not to consumer rights you have in the Service itself, and only where the claim arises from your own breach of these terms.

Ending your use

You may stop using the Service at any time; your comics remain on your device until you delete them. We may suspend access if these terms are breached in a way that is unlawful or harms the Service or other users.

Changes

We may update these terms. The date at the bottom of this page shows when they last changed.

Where you are, and which law applies

Comics That Pop is operated from Spain, and these terms are governed by Spanish law. Wherever you live, that does not take away protections your own law gives you:

In the EU or EEA, you keep the mandatory consumer law of your country of residence and may bring proceedings there.
In the United States, you keep any rights your state’s consumer protection law gives you, which nothing here is intended to displace. The withdrawal period described under Cost is an EU right and does not apply to you — our refund policy below does.
Anywhere else, the same principle: local consumer rights that cannot be contracted away are unaffected.

Because we operate from the EU, we apply the same data protection standard to everyone, wherever you live, rather than a weaker one outside Europe. See the Privacy Policy.

Refunds

If something we sold you does not work, tell us and we will put it right or refund it. Specifically:

Credits that failed to produce anything are returned automatically — you should never pay for a generation that did not happen.
Unused credits can be refunded within 14 days of purchase, in the EU as a legal right and elsewhere as our policy.
Nothing recurring. Credits are bought a pack at a time, so there is no subscription to cancel and nothing that charges you again on its own.

Credits already spent are not refundable, because the images were generated and the cost was incurred. If you think something has gone wrong, email hello@comicsthatpop.com — we would rather sort it out than argue about it.

Printed books

A printed comic is made to order from your own material. Nobody else can use it, so it is not stocked, and there is nothing to send back.

If it arrives faulty, we replace it. Printing errors, binding that fails, pages missing or out of order, and damage in transit are all on us. Email hello@comicsthatpop.com within 30 days with a photograph of the problem and we will reprint and re-send it, or refund it if you would rather. You keep the faulty copy — posting it back would cost more than making a new one.

If it never arrives, tell us and we will reprint once the carrier’s tracking makes it clear it is lost.

What we cannot refund is a book that was printed correctly from what you sent — a photo that came out soft, a name spelled wrong, or a bubble too close to the edge. The app checks for these and warns you before you order, which is the only moment they can still be fixed. If a warning was shown and the order went ahead, the reprint is chargeable. First mistakes we tend to treat generously; that is goodwill rather than a right.

Change of mind. Because each book is personalized and made for you, it is exempt from the 14-day withdrawal right that applies to ordinary goods, and cannot be cancelled once printing has begun. You can cancel any time before that. This does not affect your rights if the book is faulty, which are unaffected by anything in this section.
